Take, for example, the recent explosion that injured a Massachusetts Telecom cable installer.  The installer was hired to install a low-voltage cable system in the dormitory of a local college.  During the installation, the man reportedly brushed up against an unmarked electrical junction box, which became electrified and exploded inches away from his body.  The explosion caused the installer to lose his balance and fall on his back, injuring his lower spine, neck, and right shoulder.

To recover for his medical expenses and receive compensation for his pain and suffering, the installer filed a personal injury lawsuit against the university that hired him and the electrical distribution company that created the junction box.  It was reportedly revealed that, during a 2009 upgrade to the junction box, a metal connect was improperly installed and left bare wire exposed.  When the inspector touched the box, it activated the wire which caused the whole device to explode. The university and manufacturer initially argued that they had done nothing wrong, but eventually agreed with the inspector’s attorneys, Joseph Regan and Kelly Spencer, to pay $1.74 million to compensate the injured worker for his expenses and injuries.

Transporting and storing hazardous chemicals can be extremely dangerous.  Companies and individuals that do so on a daily basis are held to a high standard of care to take every precaution necessary in order to prevent harm and toxic exposure.  When an incident does occur, it can have a catastrophic result.

Take, for example, a recent explosion in Harris Country, Texas that left one utility worker dead.  Twenty-seven-year-old Josua Wade Petrie was a plant operator at a natural gas processing plant.  One day, one of the plant’s hot oil heaters unexpectedly stopped working. Petrie attempted to restart the heater, but it was nonresponsive.  Petrie examined the heater’s four pilot lights and instructed another operator to allow gas to enter to reignite the pilot lights.  They attempted this several times, but without success.

Petrie reportedly next attempted to light another burner with a different operator. But unknown to the operators, their attempts to reignite the heater caused an accumulation of gas around the burners.  According to lawyersandsettlements.com, when Petrie attempted to ignite the second burner, the gas combusted, causing a large and forceful explosion.  Petrie was killed instantly.  Petrie’s family filed a wrongful death lawsuit and was awarded $82.5 million in personal injury damages.

On July 2, 2015, Viola Montes was volunteering at a food concession stand at the Lincoln County, New Mexico fairgrounds when a propane tank exploded. Montes was severely injured and had burns over 80 percent of her body. She succumbed to her injuries on July 19, 2015.

According to Ruidos News, Montes’s husband has filed a wrongful death lawsuit against Pinnacle Propane LLC, Allen Sultemeier, the Lincoln County Commission and the County Fair Association. Montes is seeking punitive damages. The lawsuit alleges: “at all times material, the county had a duty to protect the health, welfare and safety of the public generally and specifically, the group of invitees on the premises of the fairgrounds.” The lawsuit further alleges that Sultemeier was a retail vendor, selling propane and filling propane tanks on county-owned premises without the proper safety equipment and in violation of applicable laws and regulations. Moreover, Montes alleges that the county and fair association knew or should have known that it did not have the necessary permits to allow propane to be safely dispensed on the premises.
